Apex Coach terms of use

Terms of use

Apex Coach is made by The Apex AI, Gold Coast, Australia. Using the app means you agree to these terms.

• Your licence. Apex Coach is licensed to you personally, for your own training on your own devices. Where these terms are silent, Apple's standard Licensed Application End User License Agreement applies.

• Who can use Apex Coach. You must be 18 or older. Setup asks your age and will not let you continue if you enter an age under 18. The app is built for adults: the plans, loads and nutrition estimates all assume an adult body, and the AI-provider features it offers are for people 18 and over under those providers' own terms. If you are under 18, please do not use it. If you set Apex Coach up before the minimum became 18 and your saved age is under 18, the app closes on your phone, keeps everything you logged, and lets you save a copy of it or erase it. Erase removes everything on this phone. If you are in a league, we remove you from it first, so erase needs a connection; if it cannot reach the league, nothing is erased and you can try again.

• Apex Pro. Apex Pro is an auto-renewing subscription, billed monthly or yearly. The price is shown before you buy. Payment is charged to your Apple Account at confirmation, and the subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel anytime in your Apple Account settings. A free trial, where offered, is once per Apple Account and converts to a paid subscription unless cancelled before it ends. Refunds are handled by Apple under Apple's terms.

• No medical advice, ever. The "Before you train" disclaimer is part of these terms. Apex Coach provides general fitness and nutrition information. It is not medical advice, not a diagnosis and not a treatment, it is not a medical device, and it is not a substitute for a doctor, physiotherapist, dietitian or any other health professional. That does not change if you tell the app about an injury, a health condition, or a treatment you are already on: Apex Coach does not recommend, supply, prescribe, adjust or advise on any medication or treatment of any kind, and nothing in it is a reason to start one, stop one, or change how you take one. Those decisions are between you and your prescriber. Anything the app shows you after you have told it about a treatment is still training and food guidance only. Get your own professional advice before acting on anything here, and where the app and a health professional differ, follow the health professional.

• Honest limits. The app adapts to what you enter. It is not watching you train: it cannot see your form during a set, and it has no view of your body except a photo you choose to send for a read. You are responsible for choosing safe loads and stopping when something feels wrong.

• Training is at your own risk. Exercise carries a risk of injury, and nutrition figures are estimates rather than a prescribed diet. You decide whether you are well enough to train, and you accept that risk. If you have a medical condition or an injury, are pregnant, or are unsure, get clearance from a health professional before you start, and again before you change what you are doing. Nothing in this paragraph limits any right you have that cannot be limited, including under the Australian Consumer Law, and it does not apply to loss caused by us.

• Liability. Nothing here excludes rights that cannot be excluded under law, including the Australian Consumer Law. Beyond those rights, and to the extent the law allows, The Apex AI's total liability in connection with the app is limited to the amount you paid for it in the twelve months before the claim, and it is not liable for indirect or consequential loss.

• Changes. Features may change between versions. If a change materially reduces what Apex Pro includes, cancelling is always available in your Apple Account settings.

• Your data. What the app stores, and what leaves your phone and why - including automatic crash reports - is set out in the privacy policy.

• Contact: michael@theapexai.com.au. These terms are governed by the laws of Queensland, Australia.

Before you train

Apex Coach provides general fitness information and workout suggestions. It is not medical advice, and it is not a substitute for a doctor, physiotherapist or other health professional.

By continuing you confirm that:

• You are 18 or older, and physically able to exercise. If you have a medical condition, an injury, are pregnant, or are unsure, get clearance from a health professional first.

• You train at your own risk. Exercise carries a risk of injury. Choose weights you can control, and stop immediately if you feel sharp pain, dizziness, chest pain or shortness of breath — and seek medical help if it persists.

• Suggestions adapt to what you enter, but the app cannot see your form or your body. Nothing it says overrides how something actually feels.

• Nutrition figures are estimates for general guidance only, not a prescribed diet. They are not suitable advice for anyone with a history of disordered eating or a medical condition affecting diet.

• Nothing here is medical advice, whatever you take. Apex Coach gives no medical advice of any kind, and it does not advise on medication. If you tell it about a treatment you are already on, it uses that only to adjust training and food guidance. It will never tell you to start, stop or change one, and it is never a substitute for your doctor or prescriber.

• Points, streaks and achievements are motivational only — they track consistency showing up, not medical or training outcomes, and are never a reason to push through pain.
